Bourmeg reserves the right to interpret and enforce this Framework in accordance with its internal policies and applicable laws.

2. PLATFORM LEGAL STATUS

Bourmeg operates as a technology intermediary platform that connects Clients and Vendors for service transactions. The Platform:

• Does not directly provide any services
• Does not employ Vendors or service providers
• Only facilitates discovery, communication, booking, and payment between Users

All transactions:

• Are executed at the sole discretion of Users
• Are based on mutual agreement between Client and Vendor

Bourmeg does not:

• Control, supervise, or manage on-ground service execution
• Guarantee the quality, safety, legality, or outcome of services

Vendors:

• Operate independently
• Are solely responsible for the services they provide

Clients:

• Are responsible for their decisions while selecting and engaging Vendors

This structure ensures that:

• Bourmeg acts only as an intermediary
• No employer-employee or principal-agent relationship is created

This legal status is aligned with:

• Section 79 of the Information Technology Act, 2000 (Safe Harbour provisions)

Bourmeg retains the right to:

• Enforce platform rules
• Restrict or remove Users
• Take action to maintain system integrity

Without altering its intermediary status.

3. APPLICABLE LAWS

Bourmeg operates in compliance with applicable laws and regulations in India. These include, but are not limited to:

• Information Technology Act, 2000
• Digital Personal Data Protection Act, 2023
• Consumer Protection Act, 2019
• Goods and Services Tax (GST) laws
• Income Tax Act, 1961
• Prevention of Money Laundering Act (PMLA), 2002

All Users agree that:

• They shall comply with all applicable local, state, and national laws
• Any activity performed through the Platform must be lawful

In case of violation:

• The User shall be solely responsible
• The Platform shall not be held liable for such violations

Automatic Legal Updates Bourmeg reserves the right to:

• Update its compliance systems
• Modify internal processes

• Changes in laws
• Regulatory requirements

Such changes:

• Shall apply automatically

Jurisdiction Awareness (IMPORTANT ADD) Users acknowledge that:

4. INTERMEDIARY LIABILITY (SAFE HARBOUR)

Bourmeg operates as an intermediary under applicable Indian laws and seeks to avail protection under Section 79 of the Information Technology Act, 2000 (“Safe Harbour”). 4.1 Intermediary Role Bourmeg acts solely as a technology platform that:

• Enables Users to create profiles, listings, and service offerings
• Facilitates communication, booking, and payments between Users

The Platform does not:

• Initiate transactions
• Select or control Users
• Modify the content shared by Users

4.2 User-Generated Content The Platform allows Users to:

• Create and publish service listings (gigs)
• Upload images, descriptions, and other content
• Communicate with other Users

Users are solely responsible for:

• The accuracy, legality, and authenticity of such content

Bourmeg does not:

• Pre-verify all content
• Guarantee that user-generated content is accurate or lawful

4.3 Conditions for Safe Harbour Protection Bourmeg shall maintain intermediary protection provided that:

1. It acts as a passive intermediary

2. It observes due diligence as required under law

3. It does not knowingly host unlawful content

4. It removes or disables access to illegal content upon receiving valid notice

4.4 Notice & Takedown Upon receiving:

• Legal notice
• Complaint from authorities
• Valid user report

Bourmeg may:

• Remove or disable access to content
• Restrict or suspend the concerned account

Such action may be taken:

• Without prior notice to the User

4.5 Loss of Protection for Users If a User:

• Engages in illegal activity
• Violates applicable laws
• Uploads prohibited content

Then:

• Such User shall lose any protection under applicable laws
• Bourmeg shall not be responsible for consequences arising from such actions

4.6 Platform Responsibility Limitation Bourmeg shall not be liable for:

• User-generated content
• Actions or behavior of Users
• Any damage arising from reliance on such content

4.7 Platform Rights Bourmeg reserves the right to:

• Monitor content using automated or manual systems
• Remove or restrict content at its discretion
• Take necessary action to maintain compliance and platform integrity

4.8 Compliance with Law Bourmeg shall:

14.3 Limited Liability Scope (BALANCED) To the maximum extent permitted by law:

• Bourmeg’s liability, if any, shall be limited to the amount involved in the specific transaction in

dispute Bourmeg shall not be liable for:

• Indirect or consequential damages
• Loss of profits, reputation, or opportunity
• Any damages arising from third-party actions

14.4 Technical & System Limitations Bourmeg shall not be liable for:

• Platform downtime or technical issues
• Delays due to system maintenance or failures
• Interruptions caused by external factors (internet, devices, etc.)

14.5 User Responsibility Users agree that:

• They use the Platform at their own risk
• They are responsible for their decisions and actions

14.6 Third-Party Services Bourmeg may rely on third-party services such as:
